Hot Topics: Construction Defect and Mechanics Liens

This program offers a practical overview of key issues in construction and real property law, with an emphasis on recent developments and common pitfalls. The construction law segment provides a concise rundown of NRS Chapter 108, including lesser-known provisions such as “disinterested owner” requirements, voidable contract clauses, prompt payment law, and the statute’s interaction with NRS 624. Attendees will gain insight into potential traps for the unwary and review recent Nevada appellate decisions that impact construction practice. The real property segment presents a broad-based look at current trends, legal developments, and items of importance in real estate law, equipping attendees with essential knowledge to navigate issues that commonly arise in this area of practice.

FACULTY
Michael E. Buckley is Director at the Las Vegas office of Fennemore. He focuses his practice on commercial real estate transactions, including mortgage and construction loans, workouts, foreclosures, acquisitions, dispositions, leases, and master-planned communities. He also advises on land use, development agreements, and CC&Rs for residential and mixed-use projects, representing lenders, developers, public entities, and nonprofits. A founding member and chair of the State Bar of Nevada’s Real Property Section, Michael played a key role in advancing legislative initiatives, including Nevada’s adoption of the Uniform Commercial Real Estate Receivership Act. A published poet and family historian, he draws on his English major roots and Jesuit education, and has traveled extensively, including work on global service projects and a year abroad with his family in England and Europe.
Ardea G. Canepa-Rotoli, a fourth-generation Nevadan born and raised in Reno, focuses her practice on real estate law, business law, and civil litigation, including construction defect cases. Before becoming an attorney, she gained over six years of experience in the real estate industry at a local title company. A partner at her firm since 2014, Ardea is licensed to practice in California and all Nevada state and federal courts. She is active in the Nevada Justice Association, serving on its Board of Governors and receiving the 2019 Badger Award for her work protecting the civil justice system. A graduate of the University of Nevada, Reno and California Western School of Law, Ardea is also committed to community service, supporting local charities, and enjoying outdoor activities with family and friends.

Membership Open to Boyd Law Students
Purpose:
To enhance the role and skills of the lawyers engaged in the practice of real property law through study, collection, development and dissemination of materials on subjects of interest to real property law practitioners; assist in the formation, administration and implementation of programs, forums and other activities for the education of members of the State Bar of Nevada in matters pertaining to real property laws and regulations; recognize and discuss means of improving the law and the practice of law in the field of real property; and act upon all matters germane to its purpose as so described or referred to by the Board of Governors.
