With the recent increase in its availability, debtors have increasingly turned to the bankruptcy provisions of Subchapter V of the Bankruptcy Code.  In this session, two Subchapter V Trustees discuss the increasing use of Subchapter V in bankruptcy reorganizations as well as best practice insights into this specialized area.

Edward (Ted) Burr heads up Mac Restructuring Advisors.  Ted has more than 30 years of corporate restructuring experience.  He has served as a financial and restructuring expert to both debtors and creditors.  He has testified in federal bankruptcy court on a variety of issues including feasibility matters, cram down interest rates, 1111(b) election issues, business valuation, and many more.  Ted is a nationally recognized expert particularly on feasibility and cram down interest rate matters. Ted is also a Subchapter V Bankruptcy Trustee for Regions 14 and 17.

Jeanette McPhearson has been involved in the analysis and practice of bankruptcy law for more than 30 years, devoting her career to matters involving financial restructuring, bankruptcy, bankruptcy litigation, insolvency and liquidation matters, and state and federal receiverships. As a result, she has a broad range of experience in representing creditors, debtors, trustees, creditors’ committees and receivers. Given this breadth of experience, she has been involved in some of the most complex and significant bankruptcy cases filed in the U.S. Bankruptcy Court for the District of Nevada.

James Patrick Shea, of Shea Larsen, has over 40 years of experience advising financial institutions, landlords, vendors, creditors’ committees, debtors, bankruptcy trustees and other parties in business bankruptcy proceedings. Jim also advises clients in commercial litigation relating to other aspects of the debtor-creditor relationship, including the enforcement of their rights in liquidations, receiverships, litigation, and informal out-of-court workouts.
