Procedure for Association of Counsel Pursuant to SCR 42 for Nevada State Courts Only

Fees

Application fee – $550 (allow 7-10 days for processing)

Expedite fee – $200 (allow 1 – 3 days for processing)

Annual renewal fee – $500

Pursuant to SCR 42(3)(a)(3) the application fees are non-refundable.

Items to Have Handy Before Starting

  • Certificate(s) of Good Standing from the bar or highest court of the state for each jurisdiction you have been admitted in issued within the past 30 days. Do not include certificates from federal courts.
  • Petitioner’s prior Nevada pro hac applications submitted within the past three years. You will need the date of application, case number, name of court, and if the admission granted or if it was denied.
  • Name, address, and Nevada bar number for the Nevada counsel of record who you will be associating with in this matter.
  • Credit card

The Process

Your application must be filed with the State Bar prior to filing the Motion to Associate with the court. Upon receipt of a complete application, payment, and Nevada consent, we will process the application and reach out to you with any questions. Upon processing, we will email the State Bar Statement, application, and certificates to Nevada counsel who will then file your Motion to Associate with the court.

After you submit your application, a copy will be emailed to you. At this time, you will want to reach out to your Nevada counsel to have them complete their consent page.

Limitations and Burden on Applicant

SCR 42 allows five applications from the petitioner within the past three years. Excess applications must be accompanied by an affidavit setting forth the special circumstances and good cause. The original affidavit must be submitted with the original application.

Motion to Associate

The motion to associate shall be filed with the court where the cause is pending by the Nevada counsel associated with the applicant, together with proof of service by mail of a copy of the motion on all parties in accordance with Nevada Rules of Civil Procedure. Nevada counsel must move the court for an order granting the applicant’s admission. A sample motion is available here.

Order Admitting to Practice

Nevada counsel must serve upon the State Bar of Nevada a file-stamped copy of the order granting or denying the admission within 10 days of issuance. A sample order is available here. Email the order to suzym@nvbar.org.

Renewal of Application

We will email an invoice to the out-of-state counsel approximately 30 days prior to the due date.

The annual renewal/anniversary date is the date the application was received at the State Bar. Please calendar this date. Out-of-state counsel who continues to act as counsel in the cause shall remit to the State Bar of Nevada an annual $500 fee within thirty (30) days of the anniversary date.

FAQ’s

Can I file my application before the case is filed in court? No. The case must be filed with the court first as you are requesting to be admitted to the specific case.

Can I use this application if my case is in a federal court?  No. Applications for pro hac vice in federal court are not processed through the State Bar.

Will I receive a copy of my application? Yes, a copy will be emailed to you immediately after you submit it.

How does my Nevada counsel know when to sign their consent page? After you submit the application, reach out to Nevada counsel and ask them to submit their consent page.

When my motion to associate is heard, where do I send the order? Email a copy of the admit/denied order to suzym@nvbar.org.

If I have had more than five applications in the past three years, how do I proceed? Complete the application and reach out to Suzy Moore at suzym@nvbar.org.

How can I supplement my application? Email the information to Suzy Moore at prohac@nvbar.org.

Do I need to submit certificates of standing from the federal courts I have been admitted to? No, we only need certificates from state jurisdictions.

Can I pay by check? Yes. Submit your application using the payment option ‘Other’. When sending a check, made payable to State Bar of Nevada, be sure to put a note with it to explain who and what it is for. Your application will be processed upon receipt of payment.

Can I pay with cash? Yes. We do not keep cash on site so exact change will be required.

Can I edit my application? No. Once you click submit you will not be able to get back into it.
